Guest Terms
Effective from 13 November 2026
In short. You book a table with the restaurant, not with Deskadora. The restaurant sets its own deposit, cancellation and no-show rules and you see them before you book. Deskadora supplies the booking tool and handles your details on the restaurant's behalf. Deskadora is not part of your dining contract and never holds your deposit: it goes through a payment company to the restaurant's own account. A deposit may be a hold on your card or a payment, depending on the booking. Tell the restaurant about any allergy directly. Your statutory rights are not affected.
1. Who is who
1.1 "Operator", "we", "us" and "Deskadora" mean Deskadora Europe SASU, 60 Rue François 1er, 75008 Paris, France, SIREN 993 470 319, RCS Paris 993 470 319, share capital 1 000 EUR, or any company to which we transfer these Terms under clause 15.2.
1.2 "The restaurant" means the venue you book with. "You" means the person making the booking.
1.3 You make your dining contract with the restaurant. The restaurant decides its own opening hours, availability, menu, deposit, cancellation rules and no-show rules.
1.4 We provide the booking tool used on the restaurant's page, its booking widget, its WhatsApp number and its phone line. We process your booking data for the restaurant.
1.5 We are not a party to your dining contract. We never receive or hold your deposit (see clause 6).
2. What you agree to
2.1 These Terms apply when you book through a restaurant's page, its booking widget, WhatsApp or by phone with its AI assistant. They sit alongside the restaurant's own terms and our Privacy Policy.
2.2 You must be at least 18, or of the age of majority where you live, to make a booking.
2.3 The restaurant's own terms apply to the meal, the venue and your visit. If they differ from these Terms on a dining matter, the restaurant's terms prevail. These Terms continue to govern the booking tool and your data.
3. Making, changing and cancelling a booking
3.1 When you book online you give your first name, last name, email and phone number. You may add special requests. Requests about health, diet or accessibility follow clause 8.4. Give accurate details so the restaurant can reach you.
3.2 Your booking has a booking reference. Keep it. It identifies your booking when you change or cancel it.
3.3 You can cancel using the link in your confirmation email, the cancel button in a WhatsApp reminder, or by contacting the restaurant. What happens to a deposit when you cancel is in clause 6.
3.4 Before you book online, the review step shows the deposit, cancellation and no-show terms. You tick separate boxes to accept these Terms, the Privacy Policy and, where a deposit applies, the deposit terms. The boxes are not ticked for you.
3.5 When you tick the boxes, we record the time, the version of these Terms and the Privacy Policy, and the deposit terms shown, with your booking.
3.6 If you book by WhatsApp or by phone, you are given the restaurant's terms and these Terms through the confirmation message or the restaurant.
3.7 A restaurant can cancel or change a booking, for example if it must close or cannot seat you. It will tell you using your contact details. If it cancels, a deposit is released or refunded in full.
3.8 We do not guarantee that a booking request is accepted. A booking exists once you receive a confirmation from the restaurant's system.
4. Restaurant rules you should read first
4.1 Each restaurant sets its own deposit amount, whether a deposit applies to your party size, how long before the booking you can cancel for free, and what happens on a late cancellation or a no-show.
4.2 These rules are shown at booking, in your confirmation and in the cancellation screen.
4.3 If the restaurant sets no free cancellation period, the default rule is that the deposit is kept. Read the rule before you pay.
5. What a deposit is
5.1 A deposit is an amount a restaurant asks for to secure a table. It is a payment to the restaurant, not to us.
5.2 The payment is processed by our payment processor, a payment company, on the restaurant's own account with that company. No fee is added to your deposit: you pay only the amount shown on the booking screen. The restaurant receives the deposit net of payment processing fees.
5.3 We never hold, receive or control deposit money. We only provide the tool through which the restaurant requests, releases, refunds or keeps it.
5.4 Your card details are entered with the payment company. We do not see or store your full card number.
5.5 When you arrive, the restaurant decides, according to its own settings, whether the deposit is applied to your bill or released or refunded to you. The booking confirmation tells you which.
6. Deposits: how your card is used
6.1 When a restaurant asks for a deposit, you save your card when you book. No money is taken and no hold is placed at that moment.
6.2 By saving your card and ticking the deposit box, you authorise the restaurant, through us as its booking tool, to place a hold on that card for the deposit amount shown, without you being present, shortly before your visit. This is your permission for that one booking.
6.3 The hold (also called an authorisation) is placed automatically 4 days before your visit. It reserves the amount on your card. It has not been taken. If your visit is less than 4 days away when you book, the hold is placed straight away. The booking screen tells you when.
6.4 Card authorisations do not last for ever. Banks and card schemes usually keep them for a few days, and some for less than 7. We therefore place the hold 4 days before your visit, and we show you the date it is expected to be placed.
6.5 Your bank may ask you to confirm the hold. If so, we send you a secure link and a deadline. If the hold cannot be placed by the deadline, the restaurant is told and decides, according to its own rules, whether to keep or cancel the booking.
6.6 The hold is released when you arrive and the restaurant does not apply it to your bill, when you cancel within the restaurant's free cancellation period, when the restaurant cancels, or when it expires. A released hold usually disappears from your statement within about 7 days.
6.7 The hold is captured, meaning taken from your card and paid to the restaurant, when you are recorded as a no-show or you cancel late, as the restaurant's stated policy provides. If the restaurant applies the deposit to your bill, it is captured on arrival. Capture is automatic and happens in the restaurant's account with the payment company.
6.8 If you cancel late, that is inside the restaurant's cancellation window shown at booking (after its free cancellation period has ended), before the hold has been placed, we place the hold on your saved card straight away and the restaurant's stated policy applies to it, up to the amount shown. If this fails, the restaurant is told and may contact you.
6.9 We remove your saved card from the payment company's systems when the hold is released or captured, when you cancel the booking, or 7 days after the date of your visit, whichever comes first. We do not keep it for later bookings.
6.10 You can withdraw your permission by cancelling the booking. Cancelling does not remove the restaurant's right to keep a deposit that its stated policy says is kept.
6.11 Refunds take 5 to 10 working days to appear on your statement. This depends on your bank.
6.12 If a hold lapses before the booking date, the restaurant may be unable to take the deposit later. The restaurant may then ask you for payment another way. The booking itself is not cancelled by us.
6.13 If you dispute a deposit with your bank, the payment company handles it with the restaurant. We do not decide it. Please contact the restaurant first.
7. No-shows
7.1 A no-show is when you do not arrive and have not cancelled.
7.2 A no-show is recorded by the restaurant's staff or by the restaurant's system after the grace period the restaurant sets. The usual setting is 15 minutes after the booking time, and the restaurant can change it.
7.3 When a no-show is recorded, the deposit rule the restaurant chose applies. It can be captured, kept or released. You are told by message. We do not charge any other fee.
7.4 If you think a no-show was recorded by mistake, contact the restaurant. It can mark you as arrived, and refund the deposit where its policy says so. We do not decide whether a no-show happened.
7.5 Where the restaurant's rule is to capture the deposit on a no-show, the system records the no-show after the grace period and captures the deposit automatically, without a person reviewing it first. This is an automated decision that is necessary for the booking contract between you and the restaurant (Article 22(2)(a) GDPR), under the deposit terms you accepted when you booked. You have the right to ask the restaurant for a review by a person, to express your point of view and to contest the decision. Contact the restaurant, or write to [email protected] and we will pass your request to the restaurant. The restaurant decides, and refunds the deposit where the no-show was recorded by mistake or its policy provides.
8. Allergies and dietary needs
8.1 Tell the restaurant directly about any allergy or dietary need, in the special requests or by speaking to staff. Do not rely on the booking tool alone.
8.2 Menus may show allergen labels suggested by an AI tool. These are indicative only. Always confirm with staff before you order.
8.3 Neither the booking tool nor the AI assistant gives medical or allergy advice.
8.4 Requests about allergies, diet (for example halal, kosher, vegetarian) or accessibility can reveal your health or religious belief. We process them only with your explicit consent (Article 9(2)(a) GDPR). In the booking widget and the WhatsApp booking flow you give it by ticking a separate box that is not ticked for you. On a call you give it by saying yes when the assistant asks. You can leave these requests out and still book. If you do not consent, the booking tool does not save the request and does not suggest tags for your guest profile from it, so tell the restaurant directly (clause 8.1). You can withdraw your consent at any time by telling the restaurant, which then deletes the request.
9. Your information and privacy
9.1 For your booking data, the restaurant is the controller. We process it on the restaurant's behalf.
9.2 Our Privacy Policy explains what we collect, who receives it and how long we keep it. It is at https://deskadora.com/privacy-policy/.
9.3 Marketing is a separate, optional choice. Ticking the marketing box lets the restaurant send you offers by email. We do not use SMS or WhatsApp marketing today. Booking without ticking it has no effect on your booking.
9.4 You can withdraw marketing consent at any time using the unsubscribe link in any marketing email.
9.5 To ask for access to your data, correction or erasure, contact the restaurant or write to [email protected]. We forward requests to the restaurant. Where the restaurant asks us to erase your data, we do so.
10. Booking by WhatsApp and phone
10.1 A restaurant may let you book on WhatsApp. This uses either an AI assistant in chat or a booking form. Your messages are processed by AI service providers, described in the Privacy Policy. Messages are kept by the restaurant's booking tool for 30 days.
10.2 The assistant tells you at the start of a chat that it is an AI.
10.3 We send booking confirmations and reminders by WhatsApp as service messages. They are not marketing.
10.4 A restaurant may let you book by phone with an AI voice assistant. It tells you at the start of the call that it is an AI assistant and that the call is transcribed. You can ask to speak to a person.
10.5 The assistant may use your phone number to recognise you as a returning guest and to find your existing bookings.
10.6 The call is transcribed to handle your booking. We do not record the audio.
11. Your consumer rights
11.1 These Terms do not take away any right you have by law as a consumer.
11.2 The legal right to withdraw from a distance contract within 14 days does not apply to restaurant or leisure services provided on a specific date. For these services, the cancellation rules in these Terms and the restaurant's terms apply.
12. Complaints and contact
12.1 For a complaint about your meal, a deposit or a no-show, contact the restaurant first.
12.2 For a complaint about the booking tool or your data, write to Deskadora Europe SASU, 60 Rue François 1er, 75008 Paris, France, or [email protected].
12.3 Disputes about a booking or a deposit are with the restaurant, which is your contracting party. If the restaurant does not resolve your complaint, you may refer it free of charge to a consumer mediator, and the restaurant must give you the details of its mediator on request (under the consumer law applicable to the restaurant). For anything about the platform itself you can contact Deskadora Europe SASU at [email protected].
13. Liability
13.1 We are responsible only for the booking tool. We are not responsible for the restaurant's service, food, deposit decisions or opening hours.
13.2 We do not limit liability that French law does not allow us to limit, including for death, injury, fraud or gross negligence. Subject to that, we are not liable for indirect loss.
14. Governing law
14.1 These Terms are governed by French law.
14.2 If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in the courts of your place of residence. Otherwise the courts of Paris have jurisdiction.
15. Changes and transfer
15.1 We may update these Terms. A new version applies to bookings made after it takes effect. It does not change a booking you have already made.
15.2 We may transfer these Terms and the related processing to another company in our group, including Deskadora Europe SRL (Romania). We will tell you by notice on our website before the transfer takes effect. All references to "Operator", "we" and "us" then mean that company.
15.3 If a clause is invalid, the rest stays in force.
